This policy explains how we collect, hold, use and disclose personal information in connection with the marketing and sale of residences at Grandeur of Epping, and how you can access, correct or complain about our handling of that information.
Who we are
DGS Property Groups ABN [DGS ABN] (we, us, our) is the developer of Grandeur of Epping, a residential development at 48–54 Beecroft Road, Epping NSW 2121 (the Project). Our registered office is G01, 13–15 Lyonpark Road, Macquarie Park NSW 2113.
Sales and marketing for the Project are conducted by Real First Pty Ltd ABN 24 605 727 679, licensed under the Property and Stock Agents Act 2002 (NSW), licence number 10035200 (the Selling Agent). This policy covers personal information handled by us and by the Selling Agent on our behalf.
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy applies to this website, our display suite, our sales team and our marketing communications.
The information we collect
Information you give us on this website
When you complete the registration form we collect:
- your first name and last name;
- your email address;
- your phone number;
- your residence preference, if you select one; and
- a record that you consented to receive marketing communications, and when.
Information you give us through our sales process
If you contact us, visit the display suite or speak with the Selling Agent, we may also collect the substance of your enquiry, your purchase timeframe, indicative budget or finance position, whether you are an owner-occupier or investor, whether you are a first home buyer, your postcode or suburb of residence, and notes made by our sales team.
If you proceed towards a purchase, we or our solicitors will collect further information required to prepare and complete a contract for sale — including identity documents, your solicitor or conveyancer's details, deposit and payment details, and information required for foreign investment, taxation or anti-money-laundering purposes.
Information collected automatically
When you visit this website our hosting and analytics providers may record your IP address, browser and device type, operating system, the pages you view, the date and time of your visit, and the website that referred you.
Sensitive information
We do not seek to collect sensitive information as defined in the Privacy Act — such as health information, racial or ethnic origin, religious beliefs or political opinions. Please do not provide it to us. If you do, we will handle it in accordance with the Privacy Act and may destroy it.
How we collect it
We generally collect personal information directly from you. We may also collect it:
- from the Selling Agent and any other agent appointed to the Project;
- from property portals, listing sites and lead-generation services where you have submitted an enquiry about the Project;
- from a person who refers you to us, where they have your permission; and
- from publicly available sources, where it is reasonably necessary for our functions.
If we collect your personal information from someone other than you, we will take reasonable steps to tell you that we have done so and why.
Why we collect it and how we use it
We collect and use personal information to:
- respond to your registration or enquiry;
- send you Project updates, release and launch information, price guides, floor plans and construction progress reports;
- invite you to display suite appointments, previews and launch events;
- arrange and follow up calls and appointments with our sales team;
- assess buyer demand so that we can plan releases and allocate residences;
- conduct market research and improve our marketing and this website;
- prepare contract documentation and complete a sale, if you proceed to purchase; and
- comply with our legal and regulatory obligations.
If you choose not to give us the information marked as required on the registration form, we may not be able to respond to your enquiry or keep you informed about the Project.
Marketing communications and your consent
When you tick the consent box on the registration form, you consent to receive commercial electronic messages from us and the Selling Agent about the Project and, where indicated, about other projects we develop. This consent is given for the purposes of the Spam Act 2003 (Cth).
Every marketing email we send includes an unsubscribe facility. You may also withdraw your consent at any time by contacting us using the details in section 15. We will action your request as soon as practicable and in any event within five business days.
We may telephone you about an enquiry you have made with us. If you ask us not to call you again, we will record that request and honour it. Nothing in this policy affects your rights under the Do Not Call Register Act 2006 (Cth).
Who we disclose it to
We may disclose your personal information to:
- the Selling Agent and any other agent appointed to market the Project;
- our related bodies corporate and the Project's development and joint venture partners;
- our customer relationship management and marketing platform providers;
- our email and SMS delivery providers;
- our website hosting, content delivery and analytics providers;
- our solicitors, accountants, auditors, insurers and other professional advisers;
- financiers and valuers of the Project, in aggregated or de-identified form where practicable; and
- government agencies, courts and regulators where we are required or authorised by law.
We do not sell your personal information.
Typefaces served by Google
This website loads its typefaces from Google Fonts. When your browser requests those files, your IP address and basic request information are disclosed to Google LLC and may be processed outside Australia. If you would prefer this not to occur, the typefaces can be served from our own servers instead — see section 8.
Overseas disclosure
Some of the service providers described above store or process data outside Australia, including in [list countries — e.g. United States, Singapore, European Union].
Before disclosing personal information to an overseas recipient, we take steps that are reasonable in the circumstances to ensure the recipient does not breach the APPs, as required by APP 8. This generally means contractual commitments about how the information is handled, stored and secured.
Security and retention
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These include access controls on our systems, agreements with our service providers, and staff training.
No transmission of information over the internet can be guaranteed to be completely secure. You send information to us at your own risk, although we will take reasonable steps to protect it once we receive it.
We keep registration and enquiry records for as long as needed for the purposes described in this policy, and for as long as we are required to keep them by law. Where we no longer need your information and are not required to retain it, we will destroy it or de-identify it. Our current retention period for unconverted enquiries is [e.g. 7 years from last contact].
Data breaches
We maintain a data breach response plan. If a breach occurs that is likely to result in serious harm to any individual whose information we hold, we will notify the affected individuals and the Office of the Australian Information Commissioner as required by Part IIIC of the Privacy Act.
Accessing and correcting your information
You may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact our Privacy Officer using the details in section 15.
We will need to verify your identity before releasing information. We will respond within 30 days. Access is free, although we may charge a reasonable fee for the cost of retrieving and supplying substantial records. If we refuse access or a correction, we will tell you why in writing and explain how to complain.
Complaints
If you believe we have breached the Privacy Act or the APPs, please contact our Privacy Officer with the details of your concern. We will acknowledge your complaint promptly, investigate it, and respond in writing within 30 days.
If you are not satisfied with our response, you may refer the complaint to the Office of the Australian Information Commissioner: oaic.gov.au or 1300 363 992.
Children
This website and the registration form are directed to people aged 18 and over. We do not knowingly collect personal information from children. If you believe we have done so, please contact us and we will delete it.
Changes to this policy
We may update this policy from time to time to reflect changes in our practices or the law. The current version is always published on this page, with the date it was last updated shown at the top. Material changes will be notified to registrants by email where it is reasonable to do so.
